Terms & Conditions
These Terms & Conditions form the agreement between Recovery Precinct (“we”, “us”, “our”) and the person or entity hiring equipment (“you”, “the hirer”). By booking, paying for, or taking possession of our equipment, you agree to be bound by these terms.
1. Definitions
• “Hirer” means the individual, company, or organization hiring the equipment from us.
• “Equipment” means all items, tools, machinery, or goods supplied under this agreement, including any accessories, manuals, or packaging.
• “Hire Period” means the agreed timeframe for which the equipment is hired, starting from the date and time of collection or delivery until the date and time of return.
2. Hire Period
• The hire period begins at the time the equipment is collected by the hirer or delivered by us.
• The hire period ends when the equipment is returned to our premises in full working order and inspected by our staff.
• Late returns will incur additional hire charges calculated on a daily or hourly rate, depending on the nature of the equipment.
• If you require an extension, you must contact us before the hire period ends. Extensions are subject to availability and may require additional payment.
• A hire agreement is required to be signed upon pickup or delivery of items. This will include a photo of driver's license for record keeping and will be sorted in a securely against loss, misuse, or unauthorized access.
3. Hire Fees & Payment
• All hire fees must be paid in full before collection or delivery unless otherwise agreed in writing.
• A security bond of $30 will be required. This will be refunded after the equipment is returned in good condition, less any deductions for damage, loss, cleaning, or late fees.
• Payment can be made via cash or bank transfer.
• All prices are in NZD and include GST.
4. Hirer’s Responsibilities
• You must use the equipment only for its intended purpose and in accordance with any instructions provided.
• You are responsible for the equipment from the moment it leaves our possession until it is returned.
• You must ensure the equipment is operated by competent and, where applicable, licensed persons.
• You must not sub-hire, lend, alter, or repair the equipment without our written consent.
• You must store the equipment securely and protect it from theft, damage, and adverse weather conditions.
5. Loss, Damage & Insurance
• You are liable for any loss, theft, or damage to the equipment during the hire period, regardless of cause.
• If the equipment is damaged, you must notify us immediately and follow our instructions regarding repair or replacement.
• You are responsible for arranging adequate insurance cover for the equipment during the hire period if required.
• In the event of theft, you must report the incident to the police and provide us with a copy of the police report.
6. Condition of Equipment
• All equipment is supplied in good working order and is tested before hire.
• You must inspect the equipment upon collection or delivery and notify us immediately of any defects or missing parts.
• Equipment must be returned clean, free of debris, and in the same condition as supplied.
• Cleaning fees will apply if the equipment is returned in an unclean state.
7. Liability
• We are not liable for any injury, loss, or damage arising from the use or misuse of the equipment, except where required by New Zealand law. • You indemnify us against all claims, damages, and expenses arising from your use of the equipment.
• It is your responsibility to ensure the equipment is suitable for your intended use.
8. Cancellations
• Cancellations made more 48 hours before the hire start date will receive a full refund.
• Cancellations made within less than 48 hours may incur a cancellation fee of $30
• No refunds will be given for early returns unless agreed otherwise.
9. Force Majeure • We are not responsible for delays, cancellations, or failure to supply equipment due to events beyond our reasonable control, including but not limited to natural disasters, extreme weather, strikes, or supply chain disruptions.
10. Governing Law
• These terms are governed by the laws of New Zealand.
• Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
